The Swiss Federal Administrative Court ruled that the transfer to Italy of an individual belonging to the group of people at especially high risk from COVID-19 is inadmissible. In light of his medical conditions and the Italian hospitals’ overcrowding, his transfer could have also triggered the risk of an inhuman or degrading treatment under art. 4 of the Charter of Fundamental Rights of the European Union and art. 3 of the European Convention on Human Rights.
